Accidents/Personal Injury

If you’ve been in an automobile accident, it’s you against the insurance company. And they’re there to protect their policyholder. It’s all business to them, and the adjuster’s job is to save the insurance company money.

You may feel overwhelmed when the accident first happens. There’s a lot of paper, phone calls and adversity throughout. You also have doctor’s visits and a lot of work forced on you. You didn’t ask for the accident to happen, but it did, and now you have to deal with it.

Then at the end you may not know what to ask for when your medical treatment is complete. The insurance company might make you an offer, but you know it’s going to be lower than you expect, and you may not know what to say to get more.

When you hire Gilpin Law, all you have to do is go to the doctor and get better. We do all of the rest of the work for you, taking away the stress and burden. Then at the end we’ll aggressively evaluate and negotiate your case. And if the final offer isn’t right, we’ll go to Court for you.

When you hire Gilpin Law, your phone calls will be returned. You’ll know what’s going on with your case. And you’ll meet with your attorney every step of the way, including during negotiations so you’ll fully understand that process of your case.

We don’t do the “junk mail,” nor are we in the yellow pages. Because we take good care of our clients and their cases we don’t need to “advertise” like that.

Business Law

If you’re thinking about starting a business or expanding business, we can help. We can start up a corporation or LLC, draft and file the documents with the North Carolina Secretary of State, obtain an Employer Identification Number for you, create a business kit to include all of your governing documents, host your first meeting and proceed from there.

We offer formation and negotiation of shareholder agreements, operating agreements and any other business document necessary for a business to start-up and grow with the goal of operating properly and smoothly. And we can continue our representation by counseling you on relationships and contracts as your business continues and grows.

Contracts & Negotiation

If you’re going to do business with someone else, whether an individual or a company, you need to have it on paper in a contract. We can put it together for you.

If you’ve been given a contract from someone else, whether an individual or a company, before simply agreeing and signing, have it reviewed. Your position could be improved. Your risks minimized. We can negotiate it for you.

Our firm has extensive experience in this area. All of our attorneys are seasoned negotiators and have substantial experience in drafting contracts, from simple and straightforward person contracts to complex business transactions.

It is worth the time and money to invest in consulting with one of our attorneys before you get in a relationship and situation that may be troublesome and difficult.

Traffic Law

If you’ve received a traffic charge, we can help. We can negotiate your ticket to get the best outcome to save you points. Often you won’t even need to go to court. Our rates are reasonable, and we make it easy for you. And you will get personalized attention; we don’t do the letters or junk mail.

We also handle Driving While Impaired charges. We’ll examine the case carefully, from the police stop through the arrest and charging process. We’ll put your case to trial if there’s an issue that could lead to your case being dismissed.

If your license has been suspended, we can take prompt action to resolve what needs to be done and work to get you eligible for reinstatement as quickly as possible. This is true no matter how many different counties and/or states are involved. Gilpin Law does have substantial experience in this area.

General Counsel

Often times internal legal departments are overwhelmed and small businesses cannot afford to staff an in-house legal department. This is where Gilpin Law can help.

In seeking general counsel type services, most companies today do not want or cannot afford to pay large firm fees and costs. They want and should expect large firm quality work, but at reasonable fees and without all the overhead and other costs associated with large firms. This is what we do.

We tailor our services to suit your needs. We can serve on a project or per matter basis, or on a temporary or long-term assignment. We are flexible, great to work with and can work with your company as independently or collaboratively as you would like.

At Gilpin Law our goal is to make it easier for corporate legal departments and smaller businesses. We do this by providing good, solid counsel in a timely manner and at reasonable rates. Did we mention, we’re also great to work with?

Litigation

If you’ve been sued or need to sue someone, you need an attorney who knows the North Carolina Rules of Civil Procedure and the case law authority very well. You also need an attorney who is experienced, aggressive and comfortable in court.

If you’ve been sued, you need an attorney who will defend your case loyally and try to bring it to an appropriate end. If you need to sue someone, whether it’s a person or company, you need an attorney who can prosecute your case aggressively and who can exercise the litigation rules to bring about justice for you, whether in a settlement, or before a judge or jury.

David Gilpin, with over 20 years of litigation and courtroom experience, can be the most effective advocate for you. His background in radio, television and theater give him a strong presence before a judge and a jury. His willingness to listen and effectively communicate make our firm your best choice for your litigation and trial needs.

Wills & Estates

We have all experienced concern about what will happen to our loved ones and family in the event of death. Who will take care of my minor children? Will money left for the care of my children be safeguarded? How will my assets be distributed? I don’t want my family fighting over my property. How can I protect my assets so my loved ones can live more comfortably after I’m gone? Will my family honor my wishes upon death? These types of questions and concerns are why you need to have your affairs in order. Otherwise, the State will decide.

At Gilpin Law we can help you with this process. We have experienced lawyers who can counsel you on the issues, help you with planning and draft all the necessary documents for you. Once all the paperwork has been finalized and is ready to sign, you will come to our offices for a formal signing process where all your documents will be properly notarized and instructions given to you on safekeeping. We see this as important, so we’re here to counsel and serve.

Workers’ Compensation

If you’ve been injured in the course and scope of employment, you have many rights under General Statute, Chapter 97, the Workers’ Compensation Act. Know that the workers’ compensation insurance adjuster doesn’t have any loyalty to you. They’re there to protect your employer, and their company. It’s all business to them.

You may be pushed in one direction or another as your claim gets under way. Or, you may feel like your claim isn’t going anywhere. You need to know that your out of work compensation benefits are being paid appropriately. You need to know that your medical treatment is in your best interest. You need someone who knows and understands the Worker’s Compensation Act, the case law authority, its annotations from case law, the North Carolina Industrial Commission Rules, the rules regarding rehabilitation professionals, and all related areas of law. That’s what David Gilpin and his 20 years of claims settlement and North Carolina Industrial Commission hearing experience can provide for you.

You’ll meet directly with your attorney, have everything explained to you, get prompt return contact and call backs. You’ll meet with your attorney again during negotiations and once your case is settled.

We don’t do solicitation letters, or junk mail. Our quality and referral basis speak for itself.
